1. ACCEPTANCE OF TERMS


By purchasing our Starlink Professional Installation Service, you ("Customer" or "you") agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before completing your purchase.

2. SERVICE DESCRIPTION

2.1 Basic Professional Installation Service Includes:

· Site Assessment: Installation technician will discuss and agree with you on optimal dish positioning based on maximum signal strength and site conditions

· Dish Mounting: Secure mounting of the Starlink dish in the agreed-upon position

· Cable Routing: Running the cable from the dish to the closest practical entry point into your home

· Router Setup: Connection and placement of the router at the closest fixed power source from where the cable enters your home

· System Configuration: Setting up the system to ensure proper operation

· Performance Testing: Conducting speed tests and signal verification

· Customer Training: Walkthrough of the Starlink app and system operation

2.2 What is NOT Included in Basic Service:

· Mounting Kit: Required for all installations and sold separately by the installation technician or at starlink.com

· Additional Equipment: Any components not included in your original Starlink kit

· Custom Installations: Any variations from the standard installation process described above

· Electrical Work: Installation of new electrical outlets or circuits

· Structural Modifications: Drilling through brick, stone, or other masonry beyond standard cable entry

· Work Requiring Special Safety Arrangements: Installations that cannot be completed by a single technician due to local safety regulations

2.3 Local Safety Regulation Compliance:

· All installations are subject to local health and safety regulations

· Basic installation coverage applies only to work that can be safely performed by a single technician in compliance with local rules

· Some jurisdictions require multiple technicians for certain work (e.g., roof installations, height work, confined spaces)

· Where local safety regulations prevent standard installation procedures, additional arrangements may be necessary at extra cost

· Technician will assess site conditions and local regulatory requirements during the initial site visit

3. PAYMENT AND PRICING

3.1 Payment

· Full payment is required before installation scheduling

· Payment is processed securely through our online platform

· All prices are as displayed at the time of purchase and include applicable taxes where required

3.2 Additional Costs

· Mounting kits, additional equipment, and custom installation work are priced separately

· Your assigned technician will provide pricing for any additional services during the scheduling call

· Additional costs must be agreed upon and paid directly to the installation technician

4. INSTALLATION PROCESS

4.1 Scheduling

· After payment, you will be contacted within 24 hours to schedule your installation

· Installation appointments are subject to technician availability and weather conditions

· You must be present during the installation

4.2 Site Requirements

· You are responsible for ensuring safe access to the installation area

· The installation site must comply with local building codes and HOA requirements

· You must obtain any necessary permissions or permits before installation

4.3 Installation Standards

· All installations will be performed according to Starlink specifications, local building codes, and applicable health and safety regulations

· Installation includes basic cable management but not concealment within walls

· Technician will determine the most practical cable routing based on your home's structure and local safety requirements

· Local Safety Compliance: If local regulations prevent certain installation methods (e.g., single-person roof work, height restrictions, confined space entry), alternative arrangements or additional technicians may be required at extra cost

5. INSTALLER RELATIONSHIP AND RESPONSIBILITIES

5.1 Independent Contractor Relationship

· SBPM Partners, LLC ("SBPM") acts as a service coordinator, connecting you with qualified independent installation technicians

· The installation technician is an independent contractor, not an employee of SBPM

· The installation technician is solely responsible for the quality and performance of the installation work

5.2 Technician Qualifications

· All technicians are certified Starlink Authorized Installers

· Technicians carry appropriate insurance and professional certifications

· Technicians must comply with safety standards and local regulations

6. WARRANTIES, LIABILITY AND DAMAGE CLAIMS

6.1 Service Coordination Warranty

· SBPM warrants that we will coordinate qualified installer services as described

· We will ensure assigned technicians are properly certified and insured

6.2 Installation Warranty and Liability

· Installation workmanship is warranted by the installation technician, not SBPM

· The installation technician is solely liable for property damage or personal injury arising from installation work

· Installation technicians carry comprehensive general liability insurance with minimum coverage as required by local regulations

· Installation technicians provide warranty coverage for their work according to industry standards

· Equipment warranties are provided by Starlink, not SBPM or the installation technician

6.3 Property Damage Claims Process

· All property damage claims must be reported to the installation technician within 48 hours of discovery

· Installation technicians are required to carry insurance covering property damage and personal injury

· Customers should document any damage with photographs and obtain repair estimates

· SBPM will provide installation technician contact information and insurance details upon request

· SBPM is not liable for property damage caused during installation work

6.4 Personal Injury

· Installation technicians carry appropriate liability insurance for personal injury claims

· Any personal injury during installation should be reported immediately to emergency services if required, then to the installation technician

· SBPM is not liable for personal injuries occurring during installation work

6.5 Limitation of SBPM Liability

· SBPM's liability is limited to refunding the service coordination fee

· SBPM is not liable for property damage, personal injury, or equipment issues arising from installation

· Claims regarding installation quality, defects, or damage must be directed to the installation technician

· SBPM is not responsible for Starlink equipment performance or service quality

6.6 Maximum Liability Cap

· In no event shall SBPM's total liability exceed the amount paid for the installation service coordination fee

· SBPM is not liable for indirect, consequential, or punitive damages

· This limitation applies regardless of the legal theory under which damages are claimed

7. CANCELLATION AND REFUNDS

7.1 Cancellation Before Installation

· You may cancel up to 24 hours before your scheduled installation for a full refund

· Cancellations within 24 hours of installation may incur a scheduling fee

7.2 Installation Issues

· If installation cannot be completed due to site conditions beyond technician control, you will receive a full refund

· If local safety regulations prevent completion of the basic installation as described, you will be offered alternative arrangements at additional cost or a full refund

· If you refuse installation after technician arrival for reasons not related to technician performance or safety compliance, no refund will be provided

8. CUSTOMER RESPONSIBILITIES

You are responsible for:

· Providing accurate site information during booking, including any known local safety restrictions

· Ensuring safe access to installation areas

· Being present during installation

· Obtaining necessary permissions from landlords, HOAs, or local authorities

· Understanding that local health and safety regulations may affect installation scope and cost

· Protecting personal property during installation

· Following technician safety instructions

· Having your Starlink equipment available on-site

9. PRIVACY AND DATA PROTECTION

9.1 Information Collection

· We collect contact information necessary to coordinate installation services

· Installation technicians may collect technical information required for service delivery

· We comply with applicable data protection laws

9.2 Information Sharing

· We share necessary contact information with assigned installation technicians

· We do not sell personal information to third parties

· We may share information as required by law

10. DISPUTE RESOLUTION

10.1 Initial Resolution

· Disputes should first be directed to SBPM customer service

· Installation-related disputes should be addressed with the installation technician

10.2 Arbitration

· Any disputes not resolved informally will be settled through binding arbitration

· Arbitration will be conducted under American Arbitration Association Commercial Rules

· Arbitration location will be Houston, Texas

· Each party bears their own legal costs

10.3 Class Action Waiver

· You agree that disputes must be brought individually and not as part of any class action

11. FORCE MAJEURE

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including severe weather, natural disasters, government actions, or other force majeure events.

12. GOVERNING LAW

These Terms are governed by Texas law, without regard to conflict of law principles.

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms constitute the entire agreement regarding installation services and supersede all prior agreements.

13.2 Modifications

SBPM may update these Terms with notice. Continued use constitutes acceptance of modified Terms.

13.3 Severability

If any provision is deemed invalid, the remaining provisions remain in effect.
